“Processor” means a natural or juridical person, public authority or agency, or any other body that processes personal data for the data controller.

“Blue Cube Carrier” shall refer to Blue Cube, the company, any subsidiary, holding company, or any subsidiary, from time to time, of that company and any subsidiary, from time to time, of a holding firm of that company

2. OBJECTIVE & SCOPE

Blue Cube Carrier. This website is operated by Blue Cube Carrier (“Blue Cube,” “we”, “our” or simply “us”) in its capacity of the controller.

This Privacy Policy explains how we handle personal data when providing transport, logistics and warehousing services to business customers (B2B) and to end customers of business customers (B2B2C), (the “Services”), and on our website bluecubecarrier.com which is intended for use within the European Union. You can also access other websites for use in other parts of the world, such as bluecubecarrier.com. Our websites in the United States, will be subject to their Privacy Policy. This Privacy Policy applies only to the personal processing data of natural persons whose data we process as a result of providing our Services or website visitors from the EU.

In certain circumstances, Blue Cube may not be solely responsible for processing your data, but is jointly responsible with other Blue Cube Logistics companies, namely Blue Cube, Inc., whose headquarters are at 155 N Upper Wacker Dr str 4250, Chicago, Illinois, 60606, United States of America, and its subsidiaries (“Blue Cube Logistics”)

3. PERSONAL DATA COLLECTED AND SOURCES

BLUE CUBE processes the following categories of personal data about you for the purposes set out in Section 4.

3.1. Personal Data Collected directly from You

Blue Cube collects your personal data electronically, in writing, verbally, and in person during our business relationship. Blue Cube may also request your personal data, including updated or corrected information.

These details include:

Information about your business, including company name and position within the company

Our responses to your inquiries and any related information, such as the subject of the query, the type of service you are interested, and the requirements for the service (including pick-up and shipping addresses and cargo specifications).

Browsing information such as your Internet Protocol (“IP”) address and Internet-connected device used to access the site, your home domain (or Internet service provider), your referrer URL (which is the URL for the website you visited before you arrived at our website), how and where you came from, what pages you viewed, how long each page took to load, and the physical location of your device or computer.

Blue Cube may collect personal data from companies within Blue Cube’s websites.

3.3. Personal data collected from third parties

Blue Cube may also receive the personal data described in Section 3.1 from third parties, including search engine optimization, web mastering, and hosting services. We may also receive them from customers and business partners.

4. PURPOSES AND LEGAL BASES FOR PROCESSING YOUR PERSONAL INFORMATION

The following purposes are the reasons we process personal data. As applicable, each purpose is identified according to Articles 6 and 9 by the legal basis for the processing. We will indicate, where applicable, whether the collection of personal data is required by law or contract. If so, the consequences of not providing such data may be discussed.

Blue Cube uses personal data to fulfill the following purposes.

4.1. Provision of services

This includes the processing of personal data to provide services to our business clients (B2B), and to customers who are customers of our business customers for their benefit (B2B2C). This includes returns and deliveries of merchandise from our business customers and other related operations.

4.2. We welcome your inquiries and communication

This includes the processing of personal data to: respond to inquiries from consumers through Build Your Project or Contact forms and other methods.

4.3. Website Administration, Optimization and Analytics

This includes personal data processing to perform system and website optimization, market research, maintenance of user login information, and analytics.

5. WHICH PERSONAL DATA SHARE DO WE PARTNER WITH?

Blue Cube is careful about sharing personal data with companies within the group.

5.1. Intra-Group

Your data may be shared with other departments within the company for the purposes set out in Section 4. You can request a list of departments by writing to the Blue Cube Carrier contact page form.

Your personal data may be shared with service providers that perform services for us, as described in Section 4. of this Privacy Policy. We share personal data with IT support providers and hosting service providers. Service providers are required by law or contract to maintain confidentiality and security of personal data and to use it only to provide requested services to Blue Cube.

Your personal data may be shared with vendors, other businesses, and business partners who perform certain functions for us. These companies will determine the purpose and/or processing methods and the lawfulness thereof.

Personal data will be disclosed to buyers, lawyers, professional advisors and courts, as well as to opposing parties or other related parties in the proceedings. This is to effect the sale or transfer of business assets, defend or enforce rights, and protect our property assets, safety, or security. We will also disclose personal information when required by law, such as when responding to a subpoena. This includes law enforcement agencies, tribunals, and courts in Blue Cube’s countries.

6. TRANSFER INTERNATIONAL OF PERSONAL DATA

We may have to transfer personal data internationally because Blue Cube Carrier can be found all around the globe and offer services. 

6.1. Intra-Group

International transfers are made to the parent company in the United States of America. Your personal data will be transferred outside of the EEA based on our intra-group Data Sharing Agreement. This agreement is based upon the standard contractual clauses of the European Commission for data transfers and complies with applicable data protection laws.

Some third parties with whom we share personal information are located outside the EEA. The European Commission has officially acknowledged certain third countries as offering adequate protection. Transfers to third-party parties in third countries other than the EEA are made using an acceptable data transfer method, such as the EU/US Privacy Shield framework to transfers to self-certified US organizations, the EU standard contractual clauses data transfers, Binding Corporate Rules and approved Codes of Conduct, certifications or in exceptional circumstances, based on permitted statutory exceptions.

7. HOW LONG DO WE KEEP YOUR DATA?

The personal data we collect about you via this website will be kept for as long as necessary to fulfill the purpose for which it was collected. Some personal data may need to be retained for longer in certain circumstances. This is to comply with or exercise legal rights or defend a legal claim.

8. RIGHTS REGARDING YOUR PERSONAL DATA

The EU data protection law provides certain rights, as outlined below. These rights can be exercised against and concerning Blue Cube entities that act as joint controllers. (For a complete list of Blue Cube departments, see Section 5.1). Blue Cube Carrier entities that act as joint controllers have made an arrangement which reflects their roles and relationships. For more information about the contractual arrangement, please refer to Section 9.

8.1. Access

You can ask us to confirm whether your personal data are being used, the relevant information required by EU data protection laws and a copy of the personal data being processed.

10. COOKIES AND OTHER TRACKING TECHNOLOGIES

Bkue Cube’s servers can place a small file called a “cookie”, on your computer or another device, to collect information about your use passively. Google Analytics is used by the website and certain parts of the System. This web analysis service, which is provided by Google, helps us understand how you use the website (or other parts of the System). Google Analytics collects information like how often people visit the website, which pages they visit, and which other websites they visited before they came to this site. Google Analytics only collects your IP address on the date that you visit the Site.
